GENERAL TERMS AND CONDITIONS OF SALE

The General Terms and Conditions of Sales that are stipulated below and any supplement that may be attached to them, constitute the total and firm expression of the contract for the sale of products or services (hereinafter referred to as Product) of ByCariola. (Who hereinafter will be called The Seller) to The Buyer, and replaces all quotes, purchase orders, correspondence or communications, whether oral or written, previously held between the Seller and the Buyer. THE CONTRACT FOR THE SALE OF THE PRODUCTS IS EXPRESSLY LIMITED TO THE TERMS AND CONDITIONS OF SALE SET FORTH IN THIS DOCUMENT. NO ADDITIONAL OR DIFFERENT TERMS PROPOSED BY THE BUYER ARE ALLOWED UNLESS THE SELLER EXPRESSES HIS WRITTEN CONSENT. There will be no other contract other than the one provided here, which cancels any other previously written. By the mere reception of our products, the clauses of this document are understood and accepted.

 

ENTIRE AGREEMENT

No amendment or modification made to this document or any declaration, representation or guarantee that is not contained in this instrument, will be binding on the part of the Seller. The transactions carried out previously, the use of the branch or a history of faithful fulfillment are not relevant to determine the meaning of this contract even when the accepting or acquiring party had knowledge of the nature of the performance and the occasion for the objection.

 

PRICES

All prices published in the corresponding lines are subject to “Change without Prior Notice”, as well as the following conditions: Decrease or Increase in factory prices on the date of shipment, for import orders. In the event of price increases or decreases, the equipment pending shipment will be invoiced at the price in effect on the shipment date. If the delivery of the product is delayed by decision or programming of the client, the prices at which it is invoiced will be those in force on the date of shipment. Any price variation will become effective on the date of appearance of the new list, letter, telegram or website where the new prices and / or discounts are announced.

 

DISCOUNTED PRODUCT SUBSCRIPTION

  • When you purchase our product subscription, you will receive an additional 5% discount off the price listed on our website at the time of subscription. From the second product delivery onwards, you will receive an increased discount of 10% on each monthly purchase. The 10% discount will remain fixed every month until the subscription is terminated.
  • The product will be delivered to the address you provide each month, and the corresponding price will be automatically charged to the payment method you provided, whether it's a credit card or another authorized method.
  • You can cancel your subscription at any time without penalties or hidden costs. The cancellation will be effective for the next billing cycle.
  • We are committed to ensuring the quality of the product delivered in each subscription cycle, as well as offering efficient customer service to resolve any questions or issues.
  • Any modifications to the subscription conditions, including changes in price or shipping policies, will be communicated to the customer in advance for timely acceptance.
  • We reserve the right to suspend the monthly subscription program at any time, which will be notified to subscribers at least 30 days in advance.

 

QUOTES

All quotations are subject to the General Conditions of Sale. Written quotes will be valid for 30 days, within which they will be subject to modifications with prior notice or may be canceled in advance by means of a written notice. Verbal quotes, unless accepted, expire the same day they are made. The Seller must receive a written purchase order the same day the award is notified, otherwise, the value of the award may be subject to renegotiation. Verbal purchase orders are not valid. When prices are firmly quoted for a product (s), they are final as long as the following conditions are met: The purchase order is accompanied by the technical specifications in accordance with those of the seller’s offer. The products are dispatched, and / or the services purchased are provided in the time agreed in the purchase order.

 

CANCELLATIONS

The Seller may suspend the order by written notification without incurring any liability on his part if the Buyer requests to extend the original delivery date for more than 1 month or if he breaches any of the terms contained in this document. The order can be canceled by the customer only in writing and against payment of the cancellation charges.

 

ACCEPTANCE

All orders are subject to acceptance by an authorized person of ByCariola.

REFERRAL PROGRAM

The By Cariola Referral Program (“the Program”) rewards customers for inviting new users to discover our products. By participating in the Program, you agree to comply with the following Terms and Conditions.

1. Eligibility

1.1. The Program is available only to individuals with a valid account on by-cariola.com.
1.2. Participants must be at least 18 years old.
1.3. The Program applies exclusively to new customers who make their first purchase using a valid referral link generated through Shopjar.

2. How the Program Works

2.1. Each customer receives a unique referral link, automatically generated by Shopjar.
2.2. When a referred friend completes their first purchase using the referral link, both the referrer and the friend receive rewards as described in Section 3.
2.3. The referred purchase must be completed during the same session opened through the referral link for the attribution to be valid.
2.4. Rewards will only be granted if the referred purchase is legitimate, completed successfully, and free of fraud or abuse.

3. Rewards

3.1. Reward for the referred friend:
The referred friend receives a $10 fixed discount on their first purchase made through the referral link.

3.2. Reward for the referrer:
The referrer receives a $10 coupon once the referred purchase has been verified and confirmed.

  • Rewards are issued automatically through Shopjar and/or Klaviyo.

  • Coupons are non-transferable and tied to the customer’s account.

3.3. Rewards have no cash value, cannot be exchanged for cash, and are non-refundable.

4. Conditions for Reward Eligibility

4.1. The referred purchase must:

  • Be made using the referrer’s exclusive referral link.

  • Be the referred friend’s first purchase on our site.

  • Be completed without returns or cancellations during the verification period.

4.2. If the referred purchase is canceled, refunded, flagged as fraudulent, or does not meet the requirements, the referrer will not receive the reward.

5. Acceptance of Terms

9.1. By using or sharing your referral link, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

1. Organizer

This promotion (hereinafter, the “Promotion”) is organized by ByCariola (hereinafter, the “Organizer”).

2. Validity

The Promotion will be valid from the date of its publication until June 24, inclusive (hereinafter, the “Validity Period”).

3. Participants

All individuals over 18 years of age who make purchases during the Validity Period through any of the following Organizer channels may participate in the Promotion:

  • Official website
  • Call center (telephone sales)

(hereinafter, the “Participants”).

4. Participation Mechanics

Participation in the Promotion is automatic with every purchase made during the Validity Period.

A minimum purchase amount of one hundred U.S. dollars (USD $100) is required to participate in the Promotion.

For every one hundred U.S. dollars (USD $100) accumulated in purchases, the Participant will receive one (1) entry into the drawing. Accordingly, for each additional multiple of USD $100, the Participant will receive one (1) additional entry (for example: USD $200 = 2 entries, USD $300 = 3 entries, and so on).

Amounts below USD $100 will not generate additional entries.

The calculation of entries will be cumulative, considering the total sum of all purchases made by the same Participant during the Validity Period, regardless of the purchase channel used.

5. Prize

The prize will consist of the selection of one (1) of the following options:

  • One (1) official Lionel Messi Inter Miami CF jersey, or
  • One (1) official national soccer team jersey selected by the Winner from the following options:
    Argentina, Mexico, United States, Brazil, France, Spain, Germany, Italy, Portugal, England, or Colombia.

All jerseys awarded will be original and/or officially licensed products.

The selection of the model, size, and national team will be subject to stock availability at the time the prize is assigned. In the event that any selected option is unavailable, the Organizer may offer an equivalent alternative of equal or similar value.

One (1) single winner will be selected (hereinafter, the “Winner”).

The prize is personal and non-transferable and may not be exchanged for cash or other goods or services.

6. Winner Selection

The Winner will be determined through a random drawing among all Participants who comply with the established conditions.

The drawing will take place on June 24.

7. Winner Notification

The Winner will be notified using the contact information provided at the time of purchase.

If the Winner does not respond within seventy-two (72) hours from the first contact attempt, the Organizer may, at its sole discretion, select a new winner.

8. Prize Delivery

Prize delivery will be handled by the Organizer.

The prize will be shipped exclusively within the territory of the United States of America, at no additional cost to the Winner.

9. Liability

The Organizer shall not be responsible for damages, losses, or injuries of any kind that Participants or the Winner may suffer as a result of or in connection with their participation in the Promotion or the use of the prize.

10. Modifications

The Organizer reserves the right to modify, suspend, or cancel the Promotion, as well as these Terms and Conditions, at any time for justified reasons, without generating any right to claim compensation by the Participants.

11. Acceptance

Participation in the Promotion implies full knowledge, understanding, and acceptance of these Terms and Conditions.
